By way of instant application, the applicant/petitioner seeks modification of condition no. (i) contained in the order dated 26.07.2024, vide which the applicant was granted regular bail, to the extent that he may be allowed to reside outside Delhi, i.e., at 29-A, Blue City Colony, Loharka Road, (Near Airport), Amritsar, Punjab.

Learned counsel for the applicant states that as per the condition no.(i) contained in the said order, the applicant was directed to not leave NCR without prior permission of the concerned court. He states that the applicant has no place to reside in Delhi and that he intends to reside at the residence of his friend, at 29-A, Blue City Colony, Loharka Road, (Near Airport), Amritsar, Punjab. It is further stated that the owners of the house, namely Shri Sukhjinder Singh Randhawa and Smt. Jaswinder K. Randhawa, have given their consent for the applicant to reside at the aforesaid house, vide an email to the concerned I.O.

Learned APP for the State has handed over the status report, which is taken on record. As per the status report, the address of the said house has been verified. Further, the fact of the receipt of email stating the consent of the owners of the said house, has also been verified by the I.O. It is also stated that the passport of the applicant is kept seized with the I.O. 4.

Learned counsel for the applicant states, upon instructions, that the applicant undertakes to appear before the concerned Trial Court on every date of hearing, unless specifically exempted. Let an undertaking in the form of an affidavit be filed by the applicant before the concerned Trial Court in this regard. Subject to filing of the said undertaking, the condition no.(i) of the bail order dated 26.07.2024 stands modified to the aforesaid extent. 5.
