The present petition under Article 227 of the Constitution of India has been filed seeking directions to the learned ADJ, East District, Karkardooma Courts, Delhi (hereinafter referred as „Trial Court‟) for early disposal of the pending application under Order XXXIX Rule 1 & 2 Code of Civil Procedure, 1908 (hereinafter referred as „CPC‟) in Civil Suit No. 396/2022 titled as "Md. Umar Farooq vs. Smt. Jasleen Kaur". 4.

It is submitted that petitioner had instituted a suit for declaration and cancellation of sale deed dated 14.08.2022 which came to be tried by the learned Trial Court. The pleadings are complete in the suit, however, since then the application under Order XXXIX Rule 1 & 2 CPC has not been disposed of.

It is further submitted that the learned Trial Court has fixed the matter for 14.08.2024 for hearing the arguments on the application. The application is being pressed as since the inception of the suit, it has not been disposed of till date.

The learned Trial Court to expeditiously dispose of the application moved on behalf of the petitioner under Order XXXIX Rule 1 & 2 CPC. 7.

With above observations, the petition stands disposed of. 8.
