By way of the present review petition, the applicant seeks a review of the judgment passed by this Court on 3rd November, 2025 in terms of which probate of the Will dated 23rd December 2020 of late Smt. Rabinder Kaur was granted in favour of the petitioner.

This petition has been filed on behalf of one Mr.

Kumar/applicant, who is stated to be the family friend and doctor of the testatrix.

It is stated that there is a subsequent Will of the Testatrix dated 22nd November, 2021 in favour of the review petitioner/applicant in respect of which the applicant has already filed probate proceedings, being Probate Petition No.15/2025, which is pending before the District Court, Saket. 6.
Mr. Hemant Chaudhary, counsel appearing on advance notice on behalf of the petitioner in the Probate Case questions the maintainability of the present review petition. He submits that the correct remedy would be to file a petition under Section 263 of the Indian Succession Act, 1925. 7.
Counsel for the review petitioner/applicant seeks time to examine the position.

Be that as it may, counsel for the petitioner submits that till the next date of hearing, the petitioner shall not deal with the following properties which are the subject matter of the Probate Petition No.15/2025 filed by the review petitioner.
