RFA 729/2023 challenges the ex-parte judgment dated 08.02.2023 and FAO No. 216/2023 challenges order dated 11.08.2023 whereby application moved under Order IX Rule 13 CPC has been dismissed. Applications have been moved in both the abovesaid matters, apprising this Court that matters have been amicably settled between the parties. 3.

Copy of the settlement agreement dated 04.01.2024 has also been placed on record and in terms of the abovesaid settlement, the appellants are not interested in pursuing with the present appeals and seek to withdraw the same.

Mr. Mukul Sharma, learned counsel for the appellants submits that in terms of settlement, payment has already been made to the respondent (plaintiff/decree holder) and, now, nothing is due with respect to decree in question.

There is also a request for refund of Court Fee. 6.

Since the settlement has taken place before any effective hearing could take place in the appeals in question, the request for refund of Court Fee is acceded to, in terms of Section 16 A of Court Fees Act, 1870 and Registry is directed to do the needful in this regard.

Appeals are disposed of as withdrawn in terms of settlement agreement dated 04.01.2024.

Pending applications also stand disposed of in aforesaid terms.
