CS(OS) 404/2020 & I.A. 3227/2026 (joint application under Order XXIII Rule 1 read with 151 CPC) 1.

The present application has been filed praying for withdrawal of the present suit in terms of the settlement agreement/MoU dated 27.01.2026. 2.

The learned counsel appearing on behalf of the parties jointly submit that during the pendency of the present suit, the parties have arrived at a settlement, the terms whereof have been reduced in writing in the form of Memorandum of Understanding/Settlement Agreement dated 27.01.2026. 3.

In terms of the said settlement, the defendants have agreed to pay full and final settlement amount of Rs.1.50 Crore. handed over by the defendant no.1's counsel to the plaintiff's counsel in the Court today by way of following two demand drafts: (i) amount of Rs.75,00,000/- by way of Demand Draft bearing No.208955 dated 02.02.2026 issued by State Bank of India, Punjabi Bagh in the name of plaintiff.

(ii) amount of Rs.75,00,000/- by way of Demand Draft bearing No.208956 dated 02.02.2026 issued by State Bank of India, Punjabi Bagh in the name of plaintiff.

Mr. Karan Khetani, the learned counsel appearing on behalf of defendant nos. 3-5 submits that his clients have no objection to the settlement.

It is further submitted that insofar as defendant no.2 is concerned, she in her written statement has already taken stand in favour of the defendant no.1.

In view of the above, the learned counsel appearing on behalf of plaintiff, on instructions from the plaintiff, who is present Court, seeks to withdraw the present suit.

The suit is dismissed as withdrawn.

In view of the above, the date already fixed i.e. 23.02.2026 stands cancelled.
