% 05.07.2017 CM APPL. 23068/2017 Vide the present application, the applicant / respondent seeks release of the amount of Rs.40,000/- deposited in an FDR in terms of the order dated 20.04.2007 by the petitioner.

The petition is indicated to have been dismissed in default and for non-prosecution vide order dated 30.10.2015 and there is nothing on record to indicate that any application has been filed for restoration of the petition. A perusal of the record of W.P.(C) 2793/2007 indicates that vide the impugned Award dated 15.01.2007 in I.D. No. 73/2006/2004 of the Presiding Officer, Labour Court NO. XII, Karkardooma Court, Delhi, the respondent / workman had been held entitled to a lump sum compensation of Rs.40,000/- in lieu of reinstatement of the job, continuity of service and back wages from management no. 1 @8% from the date of the Award till realization of the said amount.

Taking into account the factum that the petitioner has not been interested in pursuing the petition, which petition has since been dismissed

in default and for non-prosecution on 30.10.2015, the CM APPL. 23068/2017 is allowed and the amount deposited by the petitioner in terms of the order dated 20.04.2007 is allowed to be released to the respondent on proof of identification being produced before the concerned Registrar. The application is disposed of accordingly.
