The present petition has been filed by petitioner under Section 482 of BNSS, 2023 (438 Cr.P.C.) seeking anticipatory bail in connection with FIR No. 523/2023, under Section 420/408 IPC registered at PS-Kalkaji. 2.
The case of the prosecution is that the petitioner while working in M/s T.R. Sawhney Motors Pvt. Ltd. (hereinafter, 'the company') as Sales Executive along with various other employees had taken amount from numerous customers and the same was not deposited in the account of the company.

granted interim protection to the petitioner subject to his joining investigation.

He submits that the petitioner has joined investigation and also has settled with one of the victims namely Imran Mia from whom, he has allegedly received an amount of Rs.54,000/-. He further contends that as regards other three victims from whom the petitioner has allegedly accepted money, petitioner has already paid an amount of Rs.1,41,000/- to Amarjit Singh, therefore the amount which remains payable to him is Rs.80,000/-. 5.
Likewise, the petitioner has paid an amount of Rs.20,000/- to Shamim and the balance payable is Rs.10,000/-.
Insofar as the fourth victim Kuldeep/Anita is concerned, amount payable as alleged by prosecution is Rs.2,43,000/-.

Mr. Dutt submits that as per the prosecution version the balance amount payable by petitioner to the victims comes to Rs.3,33,000/-. 7.
He, on instructions from petitioner, submits that the petitioner, without prejudice to his rights and contentions, is ready to voluntarily deposit an amount of Rs.2,00,000/- with the Registrar General of this court. 8.
Having regard to the nature of allegations and the statement made by Mr. Datt, it is directed that in the event of arrest, the petitioner be released on bail on his furnishing a personal bond in the sum of Rs. 30,000/- with one surety of the like amount, to the satisfaction of the Arresting Officer/IO concerned and further subject to the condition that petitioner shall deposit an amount of Rs.2,00,000/- within a period of two weeks from today as undertaken, in the name of Registrar General of this Court, further subject to the following conditions:

The amount of Rs.2,00,000/- so deposited by petitioner with the Registrar General Court of this Court be kept in interest bearing FDR initially for a period of one year on an auto-renewal mode. 10.
It is clarified that the observations made herein above are only for the limited purpose of deciding the present bail application and the same shall not be construed as an expression of opinion on the merits of the case. 11.
The petition stands disposed of.
