Petitioner impugns order dated 14.02.2019, whereby, leave to defend application of the petitioner has been dismissed and an eviction order passed.

Respondent had filed the subject eviction petition seeking eviction of the petitioner on the ground of bonafide necessity under Section 14(1) (e) of Delhi Rent Control Act, 1958 from one shop in property bearing No.5266, Kolhapur House, Kamla Nagar, Delhi, more particularly as shown in red colour in the site plan attached to the eviction petition.

Learned counsel for the petitioner submits that the petitioner has surrendered his tenancy and handed over the peaceful vacant possession of the premises to the respondents. RC.REV. 484/2019

Learned counsel for the respondents confirms that possession has been received.

Learned counsel for the parties submit that all the disputes inter se the parties have been settled and now no claim is left against each other.

Learned counsel for the petitioner seeks leave to withdraw the petition.
