Petitioner seeks quashing of summoning order dated 05.08.2023 passed by the learned trial magistrate under Section 138 Negotiable Instruments Act.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition with liberty to raise all grounds mentioned in the petition as defence in trial alongwith an application seeking permanent exemption of the petitioner from personal appearance before the trial court.

Accordingly, the petition is dismissed as withdrawn with liberty as sought. At this stage, it is submitted by learned counsel for petitioner that the trial proceedings are listed tomorrow itself and it would not be possible for the petitioner to travel down to Delhi from Karnataka. Therefore, the learned trial court is requested not to insist for physical appearance of the petitioner tomorrow, though she would appear through videoconferencing.
