This is a petition filed on behalf of the Petitioner-M/s Metrro Waste Handling Pvt. Ltd. under Section 14 and 15 of the Arbitration and Conciliation Act, 1996. The Petitioner vide the present petition is seeking appointment of a substitute arbitrator in place of the erstwhile ld. ArbitratorMr. Justice Talwant Singh (Retd.) who has withdrawn from the present proceedings due to personal reasons.

The matter was referred to the ld. Arbitrator vide order dated 3rd July, 2023 in ARB.P. 353/2023 titled M/s Metrro Waste Handling Private Limited v. Delhi Jal Board. However, on 10th May, 2024 the parties received a letter by way of an email from the ld. parties that he is withdrawing from the arbitration proceedings due to personal reasons.

The Court has perused the said letter wherein the ld. Arbitrator has cited personal reasons for withdrawal from the present proceedings. 5.

It is submitted by ld. Counsel for the Respondent that pleadings have been completed in the matter and currently evidence is going on claims 1 to 6.

Considering the fact that the ld. Arbitrator has withdrawn, Justice Indermeet Kaur Kocchar (Retd.) [M: 9910384614] is appointed as the ld. Sole Arbitrator to adjudicate the disputes between the parties. 7.

The arbitration shall proceed from the stage where the erstwhile ld. Arbitrator has withdrawn. The arbitration shall be continued under the aegis of the DIAC on the same terms as contained in the previous order dated 3rd July, 2023.
