CORAM:

JUSTICE S.MURALIDHAR JUSTICE TALWANT SINGH

O R D E R

% 19.08.2019

1. These petitions seek a similar prayer to restrain the Respondents from dispossessing the Petitioners from different plots in Khasra Nos.629, 633 and 634 in Shyam Vihar Phase-I, Z-Block, Najafgarh, New Delhi (hereafter „the land in question‟).

2. Admittedly for the acquisition of the land in question, notifications were issued under Section 3A of the National Highways Act, 1956 („NH Act‟). Further the admitted position is that the Petitioners‟ objections under Section 3C (1) of the NH Act have been rejected by the Competent Authority under Section 3C (2) of the NH Act. The further admitted position is that under Section 3D of NH Act a declaration has now been published on 17th August 2019 where inter alia it is stated that interested persons can come forward to make claims for compensation under Section 3G (3) and (4) of the NH Act.

3. It does appear, therefore, that the Respondents have been proceeding in accordance with law thus far. Counsel for the Respondents assure the Court that all further steps will also be taken only in accordance with law.

4. In that view of the matter no further directions are called for. The petitions are disposed of. Pending applications are also disposed of. S. MURALIDHAR, J.
