By way of the instant petition, the petitioners seek quashing of FIR bearing no. 186/2020 dated 18.06.2020, registered at Police Station Maidan Garhi, South District, Delhi for the commission of offence punishable under Sections 307/34 of the Indian Penal Code, 1860 (hereafter „IPC‟). 4.

Briefly stated, the facts of the present case are that petitioners and respondent no. 2 were involved in a longstanding property dispute. On 18.06.2020, the situation escalated due to installation of a gate in the common passage - a matter linked to the ongoing dispute. As a result of which, altercation occurred between the parties. Subsequently, based on a complaint filed by respondent No. 2, the present FIR was registered against the petitioners under Sections 307/34 of IPC. After investigation, the chargesheet was filed before the concerned Court. It is further stated that with the intervention of respectable persons and relatives of the parties, both the parties have settled all their disputes vide Settlement Deed dated 05.04.2025.

The learned APP for the State submits that the chargesheet in this case was file for commission of offence punishable under Section 307/148/149/34 of IPC, however, the charge was framed for offence punishable under Section 308/143/148//149/34 of IPC. He further submits that the injuries sustained by respondent no. 2 are opined to be simple in nature and that the petitioners have no previous involvement in any other case.

On a query made by this Court, respondent no. 2 who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat and he has no objection, if the present FIR is quashed. 8.

will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.
Accordingly, FIR bearing no. 186/2020 dated 18.06.2020, registered at Police Station Maidan Garhi, South District, Delhi for the commission of offence punishable under Sections 307/34 of IPC and all consequential proceedings emanating therefrom are quashed, subject to the petitioners depositing cost of Rs. 5,000/- each with the Advocates‟ Welfare Fund, Saket Courts, Delhi within a period of seven days from date and a copy of the receipt be also filed with the Registry to show compliance of the order. 10.
In view of the above, the present petition stands disposed of. 11.
