O R D E R
% 09.03.2019 Both the parties have mutually arrived at a settlement. As per same, the insurance company has agreed to pay a sum of 8.30 lakhs (Rs. Eight lakh Thirty Thousand) towards all the claims against the Insurance Company.
It has been pointed out that 10,50,000/- (Rs. Ten lakhs and fifty thousand) was deposited by the Insurance Company with this Court and out of the same, 60% which comes to 6,30,000/-, has already been released to the deceased-injured during his lifetime. Consequently, it is mutually agreed that a further sum of Rs. 2 lakhs out of amount lying deposited with this Court, be released to Sh. Nand Kishore, who is stated to be the natural father and the only legal heir of the deceased-injured. Thus, the claim made in the petition in which impugned award has been passed shall stand fully satisfied. Since the
injured has died during the pendency of the appeal, therefore, the FDR amount may be released to Sh. Nand Kishore on verification. The statutory amount of Rs.25,000 with interest, if any, be released to the insurance company.
The impugned award stands modified to that effect.
