This hearing has been done through hybrid mode. 2.

This is a petition filed on behalf of the Petitioner-M/s Bawana Infra Development Pvt. Ltd.

under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the ld. Arbitral Tribunal.

The disputes in the present case are stated to have arisen with respect to the Concession Agreement dated 20th July, 2011 entered into between the parties herein. The said agreement contains the arbitration clause 19.3 per which, on 2nd June, 2022 the ld. Arbitral Tribunal was appointed. 4.

It is stated that pleadings in the proceeding before the ld. Arbitral Tribunal were completed on 3rd December, 2022 and on 15th May, 2024 cross examination of the witnesses was concluded. 5.

The submission on behalf of the Petitioner is that the mandate is about to expire in June, 2024.

the aspect of extension of time, ld. Arbitrator records as under:- "9. Be it noted, the time for pronouncement of the award, as envisaged under Section of the Arbitration and Conciliation Act, 1996, is going to expire on 03.06.2024.

Counsel for the Claimant, submitted that he will file the requisite application for extension of time till the end of January 2025 before the Hon'ble High Court of Delhi within 10 days hence, that is, on or before 25.05.2024. 11.

Counsel for the Respondent, very fairly stated that if an advance copy is provided to her, she will appear in Court and give consent on behalf of the Respondent for extension of time."

In view of the above, the mandate of the ld. Arbitrator is extended till 31st January, 2025.
