O R D E R

The present petition raises a grievance as regards alleged illegal constructions and encroachment at property bearing Flat no. 9238, C-9, Vasant Kunj, New Delhi-110070.

Learned counsel for the MCD, who appears on advance notice submits that a demolition order has already been passed qua the unauthorized construction in the property bearing Flat No.9238, C-9, Vasant Kunj, New Delhi-110070. A copy of the demolition order has been handed over during the course of hearing. The same clearly mentions presence of "unauthorized construction in the shape of deviation against SBP at third floor and entire fourth floor".

Learned counsel for the MCD submits that the demolition action to remove the unauthorized construction shall be taken expeditiously and in any event within a period of four weeks from today. 4.

The aforesaid statement is taken on record. No further orders are required to be passed in the present petition. The same is accordingly, disposed of.

Needless to say, any action taken by the MCD shall be subject to the statutory/appellate remedies of the owner/occupier of the property in question.
