Heard the learned counsel for the appellant.

On being pointed out that for seeking expunction of certain remarks which are contained in paragraphs 3 and 4 of the order of the learned Single Judge which is under challenge herein, the appropriate recourse would be to move an application before the learned Single Judge by apprising the learned Single Judge of the facts, learned counsel for the appellant states that this appeal may be permitted to be withdrawn with the liberty to the appellant to approach the learned Single Judge.

Accordingly, this appeal is dismissed as withdrawn.
