Heard learned counsel for the appellant.

This Letters Patent Appeal seeks to challenge the order dated 09.05.2025, passed by the learned Single Judge whereby, the writ petition has been disposed of with the observation that in case, a hearing is sought by the father of the concerned minor child (in whose favour application for passport has been made before the Regional Passport Office), the same shall be granted to the father by the concerned authority. 3.

Learned counsel for the appellant has stated that observations made in paragraph no.5 of the impugned order are prejudicial to the appellant. 4.

submission made by learned counsel for the appellant that the said observations in any way can be said to be prejudicial to the appellant for the reason that the contents of paragraph no.5 only records the submissions made before the learned Single Judge on behalf of respondent no.1 in the writ petition and the same cannot be said to be any opinion or finding recorded by the learned Single Judge.

At this juncture, learned counsel for the appellant states that he may be permitted to withdraw the appeal with the liberty to seek hearing and make submissions before the Regional Passport Office. 6.

In view of the aforesaid, the appeal along with pending applications is hereby dismissed as withdrawn with the liberty as prayed for.
