Petitioner has approached this Court with the following prayers: "i. Issue a writ in the nature of issuance of writ in the nature of mandamus or any other appropriate writ in order to direct the respondents to act on the cabinet modalities of 1999(d) and 2002(d) disposing off the proposals/recommendations pending before the respondents;

ii. It is stated that a decision has already been taken by the Union of India on 16.05.2024. A decision in this regard has been communicated by the Under Secretary, Government of India to the Director, Scheduled Castes Welfare, Government of Odisha, and the same reads as under: "Subject: Request for exclusion of Dewar, Keuta, Kaibartha, Dhibara community from the list of Scheduled Castes of Odisha- reg.

Sir.

I am directed to enclose herewith representation 24/03/2024 (copy enclosed) of Shri Bhajaman Behera, Plot No. 190/197, Raghunath Nagar, PO- Sisupalgarh, PS- Dhauli, Bhubaneswar, Khurda, Odisha- 751002 on the subject mentioned above for taking appropriate action in the matter under intimation to the petitioner directly."

In view of the above, the present Writ Petition has become infructuous.

Accordingly, the Writ Petition is disposed of as infructuous along with the pending applications, if any.

It is always open for the Petitioner to challenge the communication dated 16.05.2024 by taking appropriate steps in accordance with law.
