This petition is filed on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the learned Arbitrator by a period of six months. 2.

Disputes having arisen between the parties in relation to LOI dated 05.04.2005 issued to the Petitioner by the Respondent for carrying out the construction works at the Chandrapura Thermal Power Station, which is a power project operated by the Damodar Valley Corporation, petition was filed by the Petitioner under Section 11(6) of 1996 Act being ARB. P. 892/2018 seeking appointment of a Sole Arbitrator, which was allowed on 16.05.2019 appointing a Sole Arbitrator. From time to time, mandate of the learned Arbitrator was extended and lastly, it was extended by this Court vide order dated 14.10.2024 in O.M.P.(MISC.)(COMM.) 809/2024, which will expire on 16.06.2025. have substantially concluded and therefore, mandate of the learned Arbitrator be extended.

Issue notice.

Mr. Ravi Krishan Chandna, learned counsel for the Respondent accepts notice and on instructions, submits that the Respondent has no objection to the extension of mandate of the learned Arbitrator as Respondent has already consented to the extension of mandate, which is recorded in the procedural order dated 14.05.2025. 5.

Accordingly, with the consent of the parties, mandate of the learned Arbitrator is extended by a period of six months from 17.06.2025. 6.

Petition is allowed and disposed of in the aforesaid terms.
