This petition is filed on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the learned Arbitral Tribunal by a period of one year.

Disputes having arisen between the parties in relation to Letter of Award dated 10.01.2019 issued by the Respondent to the Petitioner for part of the work relating to project for 'Widening and Reconstruction of Madhya Pradesh Major District Roads Upgradation Project', awarded to the Respondent, parties resorted to conciliation process under the MSME Act, 2006. Facilitation Council to Delhi International Arbitration Centre ('DIAC') for appointment of an Arbitrator. On 18.07.2023, learned Arbitrator was appointed and after entering upon reference, arbitral proceedings commenced. It is stated in the petition that arbitral proceedings are at the stage of Claimant's evidence and two witnesses have been summoned, however, since the mandate will expire on 11.07.2025, this petition is filed for extension of the mandate well in time.

Mr. Vaibhav Tyagi, learned counsel for the Respondent accepts notice and on instructions, submits that the Respondent has no objection to the extension of mandate of the Arbitral Tribunal. 7.
Accordingly, with the consent of the parties, mandate of the learned Arbitral Tribunal is extended by a period of nine months from 12.07.2025. 8.
Petition is allowed and disposed of in the aforesaid terms.
