O R D E R

% 17.02.2020 CM APPL. 54669/2019 (for release of amount) This application seeks release of amount of Rs. 50,000/-, which was deposited in terms of this Court's order dated 10.05.2007. The writ petition was dismissed vide this Court's order dated 02.11.2015.

It is an admitted position that respondent no. 2-workman, who resumed his services with the petitioner, has superannuated. Nevertheless, he is required to be paid some amount, from the date of termination of his services till the passing of the award.

According to Mr. Atul, the learned counsel for R-2, the amount due is in the range of Rs. 5,00,000/- to Rs. 6,00,000/-, alongwith consequential benefits. Therefore, the said amount of Rs. 50,000/- may be released to respondent no. 2. As per the petitioner's calculation, he has already been paid Rs. 1,42,158/- from March 2006 to May 2009, on the basis

of minimum wages.

However, it is not in dispute that some more monies would be payable which would, in any case, be more than Rs. 50,000/- i.e. the amount deposited in this Court.

In view of the above, let Rs. 50,000/-, alongwith interest accrued thereon, be released to the respondent.

The learned counsel for the parties seek time to obtain instructions and file requisite computations for monies payable since the year 2000 onwards.

Let the same be done before the next date. Advance copies of the same be exchanged between the parties.
