O R D E R

The present writ petition has been filed praying for directions to the respondent no. 1 to stop the ongoing illegal and unauthorized construction carried out by respondent no. 4 in Plot measuring 400 Sq. Yds. bearing No. E-6/2AB, Old Jasola Village, Khasra No.242, Jamia Nagar, New Delhi110025. 2.
Responding to the aforesaid writ petition, learned counsel for respondent no.1, i.e., Municipal Corporation of Delhi ("MCD"), submits that a Show Cause Notice dated 23rd May, 2025, has already been issued and the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned counsel for respondent no. 1/MCD further submits that a Work Stop Notice dated 20th May, 2025, has already been issued to the Station House Officer ("SHO"), Police Station, Sarita Vihar. 4.
Considering the aforesaid, it is directed that the MCD and the SHO, Police Station, Sarita Vihar, shall ensure that no further unauthorized construction takes place in the property in question. 5.
Additionally, any unauthorized construction going on in the property in question, shall be stopped forthwith.

Further, it is directed that the MCD shall take action against the unauthorized construction, by following due process of law. 7.
Rights and contentions of all the parties are left open. 8.
In case the owner/occupant of the property in question is aggrieved by any action of the MCD, which is not taken as per law, the said owner/occupant of the property, shall be at liberty to seek his remedies in accordance with law.

At this stage, this Court notes that the petitioner in the present case is one Smt. Hasin, who stays in Bareilly, Uttar Pradesh. On a pointed query as to why the petitioner is interested in the present property, learned counsel for the petitioner submits that the petitioner is the owner of the property in question. However, she stays in Uttar Pradesh. 10.
This Court shall not go into any title dispute pertaining to the property in question. Any action taken by the MCD shall be uploaded on the website of the Special Task Force ("STF"). The STF shall also ensure that due action against unauthorized construction, shall be taken in accordance with law. 12.
With the aforesaid directions, the present writ petition, along with the pending application, is disposed of.
