This order is being passed in continuation of the order passed on 14.08.2024 when this Court after considering the submissions of both parties had come to the conclusion that the petitioner was entitled to be appointed as a Constable (GD) under the Economically Weaker Section [EWS] category pursuant to the selection process conducted in furtherance of the advertisement dated 27.10.2022. Taking into account that the petitioner's candidature has been erroneously rejected even before he could be allotted a specific Central Armed Police Force (CAPF), the matter was adjourned to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Today, learned counsel for the petitioner submits that the petitioner is desirous of joining the Central Reserve Police Force [CRPF] for which he had duly opted and had obtained more marks than the cut-off marks in the EWS category for appointment in the CRPF as a Constable (GD). He, therefore, prays that the respondents be directed to appoint the petitioner in the CRPF as a Constable (GD) without any further delay. 5.

Learned counsel for the respondents, on instructions, submits that in his application form the petitioner had filled CRPF as his 5th option and Border Security Force [BSF] as his 8th option and as per the marks obtained by him, he is eligible for appointment in both the CAPFs. He hands over a copy of the petitioner's application form which is taken on record. 6.

In light of the aforesaid stand taken by the parties and having perused the petitioner's application form, we allow the writ petition by directing the respondents to appoint the petitioner as a Constable (GD) in the CRPF within a period of four weeks. However, as already directed on 14.08.2024, the petitioner will neither be granted any retrospective seniority nor arrears and his pay will be fixed from the date he joins the CRPF as a Constable (GD).

At this stage, learned counsel for the respondents submits that even though he had appeared and argued the matter on behalf of the respondents on 14.08.2024, the said order inadvertently does not record his appearance. He, therefore, prays that it may be clarified that he had appeared on behalf of the respondents on the said date. Learned counsel for the petitioner supports this prayer made by the learned counsel for the respondents.
