% 14.07.2017 Petitioner has assailed the order dated 25th July, 2016 passed by the learned Metropolitan Magistrate, Delhi, whereby petitioner has been summoned under Section 138 of the Negotiable Instruments Act, 1881. Petitioner was arrayed as accused no. 4 in the complaint. Learned counsel for the respondent (complainant) submits that complaint is not being pressed against the petitioner, who is accused no. 4 before the trial court.

Therefore, present petition may be allowed and impugned order qua the petitioner only may be quashed. Accordingly, since the complaint is not being pressed against the

petitioner (accused no. 4) the impugned order qua the petitioner (accused no.

4) is set aside.

Petition is disposed of in the above terms.
