By the present petition, the petitioner challenges the order dated 27.05.2023 (hereafter 'impugned order') passed by the learned Additional Sessions Judge, Karkardooma Courts, Delhi in SC No. 306/2016 whereby the application filed by the accused persons under Section 311 of the Code of Criminal Procedure, 1973 ('CrPC') was allowed and the petitioner as well as one witness namely Karan Singh were recalled for cross examination. 2.

From a perusal of the impugned order, the reason which motivated the learned Trial Court to allow the application filed by the accused persons under Section 311 of the CrPC is not clear.

The learned Trial Court though noted the reason for which the application under Section 311 of the CrPC was filed by the accused persons, however, the Court did not give any reason for The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. allowing the same except for stating the law in that regard. 4.

The order, thus, is bereft of any reasons and is consequently set aside. The matter is remanded back to the learned Trial Court for passing a fresh order. 5.

Let the matter be listed before the learned Trial Court on 15.10.2025 for passing a fresh order after hearing the parties on the application under Section 311 of the CrPC. 6.
