Petitioner happens to be respondent before the learned Trial Court and has challenged order dated 06.07.2022 whereby the delay in filing the written statement was not condoned and resultantly, written statement was directed to be taken off the record.

At the very outset, Mr. Singh, learned counsel for the petitioner states that there is subsequent development as the matter has been amicably settled and even the suit has been withdrawn by the plaintiff. 3.

Viewed thus, actually speaking, nothing survives in the present petition as the matter has now become infructuous.

Present petition is accordingly dismissed, as having become infructuous.
