A Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the Petitioners for quashing of FIR NO.160/2016 under Section 323/506/147/149/34 IPC registered at Police Station Bhalswa Dairy, Delhi, in terms of the Settlement on the basis of „No Objection‟ given by Respondent No.2 HC Vinod Kumar.

Though, the quashing has been sought on the ground that the Respondent No.2 HC Vinod Kumar has „No Objection‟, but there is no Affidavit or Certificate of HC Vinod Kumar annexed along with the Petition.

Learned Standing Counsel submits that it is a peculiar case where charges are under Section 147/149 aside from Section 323/34 and 506/34 IPC. This being a case of driving there can be no quashing and no consent can be given by HC Vinod Kumar.

Submissions heard.

There is merit in the submissions made by the learned Standing Counsel that the offences under which the FIR has been registered does not merit any quashing on Settlement. Moreover, the Chargesheet already stands filed.
