O R D E R

The present writ petition has been filed for directions to respondent nos. 1 to 3, to not allow any illegal and unauthorized construction and to stop further illegal and unauthorized construction being undertaken at the property bearing no. 51/30, Old Rajender Nagar, New Delhi-110060, by respondent no. 4.

It is submitted that the petitioner is the co-owner of the property in question and the said property consists of ground floor, mezzanine floor, first floor and second floor.

It is further submitted that unauthorized construction has been carried out by respondent no. 4 on the third floor of the property, in question. 4.

Corporation of Delhi ("MCD"), submits that cognizance of the unauthorized construction on the third floor of the property in question, has already been taken and subsequently a Demolition Order dated 27th March, 2023 has also been passed.

She further submits that, however, action against the said property could not be taken for want of police assistance. 6.

She also submits that photographs attached with the present petition pertain to the year 2023, and no fresh photographs have been attached, to show any ongoing unauthorized construction in the property in question. 7.

In furtherance of the aforesaid, she shows the photographs of the said property that were clicked today morning by the officials of the MCD, to submit that apparently no fresh construction is being undertaken at the property.

Be that as it may, since Demolition Order dated 27th March, 2023, has already been issued by the MCD, the MCD is directed to take action, in accordance with law.

Noting the aforesaid, the present writ petition, along with pending application, is disposed of.
