O R D E R

The present writ petition has been filed for directions to respondent nos. 1 to 3, to demolish the illegal and unlawful structure raised by respondent no. 4, without any sanction plan, over the property bearing no. A186, Gali No.5, Block A-6, near Gym Club, Sonia Vihar, Delhi-110094. 2.

Learned counsel for the petitioner submits that despite the order dated 07th October, 2024, passed in W.P.(C) 14157/2024, titled as "M.P. Mishra Versus Municipal Corporation of Delhi And Ors.", no action has been taken against the unauthorized construction existing in the property in question. 3.

Per contra, learned counsel for respondent nos. 2 and 3/Municipal Corporation of Delhi ("MCD"), has handed over a copy of the Show Cause rd May, 2025, to submit that the unauthorized construction Notice dated 23 existing in the property in question, has been booked. She, however, submits that the said property is old and occupied.

Likewise, learned counsel for respondent no. 1, i.e., Special Task Force ("STF"), draws the attention of this Court to the Status Report filed on behalf of MCD before the Appellate Tribunal MCD ("ATMCD"), wherein, MCD has categorically stated that no fresh unauthorized activity was going on in the property in question. Further, no building material was found stacked in or around the property in question. Thus, learned counsel for the STF submits that there is no ongoing construction in the property in question and that the same is old and occupied.

Noting the aforesaid, it is directed that MCD shall take action, in accordance with law.

Considering the aforesaid, no further orders are required to be passed by this Court, at this stage.

The present petition, along with the pending application, is accordingly disposed of.
