This is a petition seeking anticipatory bail in the FIR No. 0111/2024 registered under Sections 419/420/120B/34 IPC and Sections 66C/66D of IT Act at PS Special Cell, Delhi.

As per the allegations in the FIR, an illegal call centre was being run at Rajouri Garden, Delhi, which was targeting innocent people based in USA by providing tech support for Charles Schwab Financial Services which offers banking services, commercial banking, investment, wealth management related services.

The petitioner, allegedly, is the one who had taken the premises on rent for running of call centre.

The petitioner was granted interim protection on 30.05.2024 and pursuant to the interim protection, the petitioner has joined investigation and is cooperating.

The other fact which weighs with me is that the main co-accused namely Luckshay Thakur, who was running the call centre, has already been granted regular bail by the learned CMM. 6.
For the said reasons, I am inclined to allow the application and in the event of arrest, the petitioner shall be released on bail on the following terms and conditions:- (i)The petitioner shall furnish a personal bond in the sum of Rs 10,000 (Rupees ten thousand only) each with 1 surety in the like amount, to the satisfaction of the concerned trial court.
(ii) At the time of furnishing bail bond, the petitioner shall provide the mobile number, which he undertakes to keep operational at all times during the pendency of the trial. (iii) The petitioner shall inform the concerned Investigating Officer about his current residential address. (iv) In case of change of residential addresses/contact details, the petitioner shall promptly inform the same to the concerned Investigating Officer/SHO.
(v) The petitioner shall join the investigation as and when asked.
(vi) The petitioner shall not leave the country during the bail period.
(vii) The petitioner shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.

Needless to state that nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case as the same has been expressed only for the purpose of the disposal of the present petition.
