The present petition is filed seeking quashing of FIR No. 0645/2024 dated 17.12.2024, registered at Police Station Ambedkar Nagar, New Delhi, for offences under Sections 498A/406/34 of the Indian Penal Code, 1860 ('IPC') including all consequential proceedings arising therefrom. 4.

Learned counsel for the petitioners submits that the complainant after her marriage, had shifted to USA and has never stayed with the petitioners. It is submitted that false allegations have been made against the petitioners, only for the reason of they being related to her husband, with whom she is involved in matrimonial acrimony. The FIR in question was registered only some time back i.e. on 17.12.2024.

Mr.Sanjay Lao, learned Standing Counsel for the State submits that the investigation is at the nascent stage and none of the petitioners, till date have joined the investigation. He submits that the notice under Section 41A was issued recently on 15.04.2025.

Undisputedly, the investigation is at the nascent stage and the police, if after inquiry finds that the petitioners have been falsely implicated in the present case or that there is no evidence against them, would shall file the closure report with regard to the petitioners.

Mr.Sanjay Lao, learned Standing Counsel for the State, on instructions, states that at this stage, no coercive steps have been proposed against the petitioners.

Considering the above, this Court does not consider apposite to entertain the present petition and pass any preemptive order. Needless to say, that the authorities ought not to be stopped from investigating on receipt of any information alleging cognizable offences. The allegations can turn out to be false after investigation, and an appropriate report, in that regard, can be filed by the authorities.
