Vide the present petition filed under Section 438 Cr.P.C. petitioner seeks anticipatory bail in case FIR No. 115/2015 registered at PS-Ranjit Nagar for the offences punishable under Sections 308/34 IPC. 2.
The aforesaid case was registered on 23.02.2015, however till date, as admitted by the ld. APP on instructions from the Investigating Officer concerned who is present in the Court, that he never issued any notice to the petitioner to join the investigation. Moreover, two accused namely Prem and Rahul have already been admitted on anticipatory bail by the ld. Addl. Sessions Judge, Tis Hazari Courts, Delhi.

Keeping in view the facts recorded above, I hereby direct the Investigating Officer concerned to release the petitioner in the event of his arrest on his furnishing a personal bond of Rs.20,000/- with one surety of the like amount to his satisfaction.

Accordingly, the petition is allowed.
