The petitioner has filed the present petition, inter alia, praying that he be released on an interim bail for a period of three months in FIR No. 386/2016 under Sections 376D/363/328/120B/228A/195A/506 of the IPC, read with Sections 6/8/17 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act).

The petitioner states that his wife requires treatment from L.N.J.P. Hospital and is scheduled to be admitted on 27.09.2019. 3.
Ms Meenakshi Chauhan, learned APP appearing for the State opposes this application and states that the petitioner has other family members who are competent to take care of the petitioner's wife. However, it is noticed that the petitioner has been released on interim bail on numerous occasions (thirteen) and there is no allegation that he has misused the same. The fact
that the petitioner's wife is ailing and requires to be treated, has also been verified.

In this view, this Court considers it apposite to grant an interim bail for a period of two weeks from the date of release, subject to the petitioner furnishing a personal bond in the sum of ₹25,000/- with one surety of the equivalent amount to the satisfaction of the Trial Court. This is subject to the following further conditions:
(a) that the petitioner shall not contact the prosecutrix or any of the witnesses or attempt to influence any of the witnesses, either directly or indirectly;
(b) the petitioner shall provide his complete contact details to the concerned SHO and ensure that he is reachable at all times. 5.
