The present petition is filed under Article 226 of the Constitution to set aside the impugned order of dis-empanelment dated 12.10.2020 bearing no. 2112/SA/4072/Delhi/Emp issued by the respondent no. 1 along with other reliefs.

The counsel for the respondent no. 1 has referred the empanelment certificate issued in favour of the petitioner, the perusal of which reflects that it was for the period with effect from 29.05.2019 to 28.05.2022 which has already been expired.

The counsel for the respondent no. 1 further stated that thereafter, the petitioner has not applied for further empanelment/renewal. It is further stated that the present writ petition has become infructuous. 4.

apprehension that dis-empanelment vide the impugned order dated 12.10.2020 may act prejudice to the interest of the petitioner. However, he seeks permission to withdraw the present petition but, with the liberty to initiate appropriate legal proceedings in case of altered circumstances. 5.

Liberty as prayed for is granted.

The present petition along with pending application is allowed to be dismissed as withdrawn.
