The present Petition under Article 226 and 227 of the Constitution of India read with Section 482 Cr.P.C. has been filed by the Petitioner seeking quashing of FIR No. 327/2016, under Section 309 IPC, registered at Police Station Chhawla, New Delhi and proceedings emanating therefrom.

Quashing of the FIR is sought on the ground that the impugned Order passed by the learned Chief Metropolitan Magistrate is violative of Section 115(C) of the Mental Healh and Care Act, 2017 whereby trial and punishment for attempt to suicide committed has been barred. It is submitted that this issue is pending consideration before the Hon'ble Supreme Court.
