This transfer petition seeks transfer of Suit Civ DJ 271/2023 (Vijay Kumar Gupta v. Sushil Kumar Goel) pending before the learned Additional District Judge, Tis Hazari Courts to this Court and heard along with CS (OS) 354/2023 (Sushil Kumar v. Vijay Kumar Gupta). Learned Counsel for the respondents has no objection subject to all rights and remedies of the respondents standing protected, including the application filed by the respondents under Section 10 of the CPC in CS(OS) 354/2023.

Reserving rights to the aforesaid extent, Civ DJ 271/2023 is transferred to this Court to be heard along with CS (OS) 354/2023. By:AJIT KUMAR Signing Date:21.01.2024 10:47 TR.P.(C.) 140/2023

The Registry of this Court and of the Tis Hazari Courts are directed to coordinate and ensure expeditious transfer of the record. Needless to say, Civ DJ 271/2023 shall continue from the stage at which it is at present.

Civ DJ 271/2023 is stated to be at the stage of completion of pleadings.

Accordingly, let Civ DJ 271/2023 be transferred to this Court and re-numbered by the Registry and listed before the learned Joint Registrar for completion of pleadings, admission and denial of documents and marking of exhibits on 28 February 2024, which is the date already fixed in the matter.
