% 07.04.2016 After some hearing, learned counsel, on instructions, sought liberty to withdraw the appeal and approach the Civil Court in a properly laid out suit for declaration of title and such consequential relief as may be available in law; he seeks liberty that in such event the observations made by the learned Single Judge could not be treated as conclusive. Liberty granted.

It is open to the appellant to seek civil remedies available in law. In such event, the observations of the learned Single Judge shall not be treated as conclusive on the merits of the dispute which shall

be independently gone into in accordance with law. The appeal is dismissed as withdrawn, but in terms of the liberty granted.
