Appellant has filed an appeal for reduction of the award dated 17.11.2014 passed by the learned MACT awarding compensation of Rs. 6,15,000/- along with interest @ 9% from the date of filing of the claim petition.

During the course of hearing, it has been apprised that respondent No.1 - Ram Charan has expired on 09.03.2021. 3.

The insurance company deposited 65% of the awarded amount along with proportionate interest in the bank in terms of the order dated 09.02.2015 passed by this Hon'ble Court and entire deposited amount released in favour of the respondent/claimant(s) in terms of the order of the tribunal.

We have interacted with the learned counsel/parties concerned. Apropos such interaction and deliberation, it is agreed between the parties that the present appeal be disposed as settled in terms of the settlement arrived in MACA No. 879/2015 Title as "Ram Charan & Anr . Vs Satender Kumar & Ors". Learned Counsel for the Insurance Company also submits that the statutory amount with interest, if any, may be refunded to the Insurance Company.

Needless to say that the appellant shall be entitled to refund of the statutory amount along with interest, if any. In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of.

A copy of this order be sent to the concerned learned Tribunal with TCR, if already received.
