The above said application has been moved by petitioner under Order XXIII Rule 1 CPC seeking withdrawal of the present contempt petition. 2.

The petitioner seeks withdrawal of the contempt petition on the basis of one endorsement dated 22.03.2024 issued by Canadian Court and besides that the petitioner also seeks liberty to revive the present petition at subsequent stage, in the event it is found necessary. 3.

It is submitted that the withdrawal is with the objective that there is no unnecessary duplication of the proceedings.

In view of the above, the application is allowed and as a necessary corollary, the present contempt petition is dismissed as withdrawn. 5.

Liberty, as prayed, is granted.

The next date of hearing is cancelled.
