At the outset, the learned counsel for the respondent points out that the Trial has already concluded and the petitioner has already been punished for contravention of offences under Section 92(5), 99 and 137(3) of the Companies Act, 2013. 2.
He further submits that the case is listed today before the Trial Court for order on sentence and the maximum punishment as provided under the Act is the payment of fine of ₹50,000/-. 3.
Considering that the trial has already concluded, this Court does not consider it apposite to pass any order in the present petition which was filed challenging the initiation of the proceedings under the Companies Act.
