% 05.02.2018 Crl.M.A. 2167/2018 (exemption) Exemption is allowed subject to all just exceptions. CRL.M.C. 593/2018 & CRL.M.A.2168/2018 (stay) 1.

The petitioner is aggrieved by the observation in order dated 06.01.2018 of the learned Trial Court, whereby, the Trial Court has observed that the accused has gifted Rs.40,00,000/- to the complainant.

Learned counsel for the petitioner submits that the said amount of Rs.40,00,000/- was received by the complainant without prejudice to his rights and contentions and at that point of time, the accused has attempted settlement with the petitioner.

The Trial Court has already directed expeditious investigation CRL.M.C. 593/2018

and called for a report from the SHO.

In view of the directions to expedite the investigation and the report called from the SHO, in my view, no further orders are called for in the present petition.

The petition is, accordingly, disposed of.

However, it is clarified that the observation referred to above, being prima facie, shall not come in the way of the investigation and the trial Court proceedings.
