CORAM:

HON'BLE MR. JUSTICE SANJEEV SACHDEVA

O R D E R

% 24.10.2019 1.

Subject petition has been filed seeking quashing of FIR No.678 dated 379 IPC, P.S.Safdarjung Enclave, New Delhi. 2.

Subject FIR was registered on the complaint of Mr.Gaurav Goel.

3.

The FIR emanates out of a family dispute and petitioner and the complainant are members of the extended family. There were other FIRs also pending inter-se between the parties. Parties were referred to mediation and a settlement has taken place whereby parties have decided to settle all the disputes and seek quashing/compounding of the FIRs inter-se.

4.

Learned counsel appearing for the respondent complainant W.P.(CRL) 2313/2019

under instructions from the complainant who is present in person in Court submits that he does not wish to press his complaint and has no objection to subject FIR being quashed.

5.

In view of the fact that parties are family members and have resolved their disputes and the complainant does not wish to prosecute the present complaint, I am of the view that continuation of the criminal proceedings would be an exercise in futility and justice in the case demands that dispute between the parties be put to an end and peace restored; securing the ends of justice being the guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

6.

In view of the above, the petition is allowed. 7.

FIR No.678 dated 379 IPC, P.S.Safdarjung Enclave, New Delhi and all consequent proceedings emanating therefrom are quashed. 8.

Order Dasti under signatures of Court Master. SANJEEV SACHDEVA, J OCTOBER 24, 2019 rk W.P.(CRL) 2313/2019
