This application is filed on behalf of the Petitioner under Chapter IV Rule 3(C) of Delhi High Court (Original Side) Rules, 2018 for condonation of delay of 5 days in re-filing the petition. 4.

Mr. Saurabh Chaturvedi, learned counsel accepts notice on behalf of the Respondent.

This petition is filed on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the learned Arbitral Tribunal upto 31.12.2025. Disputes having arisen between the parties in relation to a Contract dated 24.03.2011 for construction of dwelling units, including allied services for officers, JCOs etc., of the Indian Army, petition was filed by the Respondent under Section 14 of 1996 Act being O.M.P. (T) (COMM.) 71/2019 for termination of mandate of Sole Arbitrator appointed by the Petitioner herein, which was allowed vide order dated 16.09.2019, appointing a substitute Arbitrator. Mandate of the learned Arbitrator was extended upto 31.03.2025 vide order dated 21.08.2024 in O.M.P.(MISC.)(COMM.) 52812024. It is stated in the petition that arbitral proceedings are at the stage of cross-examination of Claimant's witnesses. Mandate of the learned Arbitrator having expired on 31.03.2025, this petition has been filed for extension.

Mr. Saurabh Chaturvedi, learned counsel for the Respondent accepts notice and on instructions, submits that the Respondent has no objection to the extension of mandate of the learned Arbitrator. 12.

Accordingly, with the consent of the parties, mandate of the learned Arbitrator is extended upto 31.12.2025 and period between 01.04.2025 to 26.05.2025 is regularised.

Petition is allowed and disposed of in the aforesaid terms.
