Regular First Appeal under Section 96 of CPC has been filed on behalf of appellant for setting aside Order and Decree dated 19.01.2024 passed by learned ADJ-01, South-West District, Dwarka Courts, Delhi, in CS DJ ADJ 1223/2022, whereby Suit of the Plaintiff / Respondent for possession has been decreed, though the matter is still pending adjudication before learned District Judge, for recovery of arrears of rent / mesne profits. 3.

Appellant was inducted as a tenant in the Suit Premises for a period of two years on 01.06.2015 and onwards vide Lease Deed dated 21.05.2015. After expiry of that period, Plaintiff sought possession, which was not handed over and consequently, present Suit was filed. 4.

Suit for Possession. Appellant, after having filed the Appeal, gave an undertaking on 30.05.2024 that he shall vacate the Suit Premises on or before 02.07.2024. Admittedly, the possession has been handed over to the Respondent on 10.07.2024.
