There is no appearance on behalf of the parties when the matter is taken up for hearing. It appears that the appellant has not appeared on several dates of hearing. By order dated 25.04.2022, Court notice was issued to learned counsel for the parties. Learned counsel for the appellant refused service stating that appellant has engaged another counsel. However, no vakalatnama of any other counsel has been filed. 2.

The office report states that service upon the respondent was effected through his brother, but it was stated that the respondent has settled in the village and that the matter has been settled. 3.

Due to non-appearance of the appellant despite notice, it appears that the appellant is not interested in prosecuting the appeal. 4.
