% 07.02.2024 CM APPL. No.7305/2024 The present application under Section 151 of the CPC has been filed by the applicant seeking disposal of the present petition bearing W.P.(C) 9023/2019 in terms of the settlement dated 6th December, 2023 arrived at between the parties.

It is submitted that all the terms and conditions as mentioned in the said settlement agreement have already been complied with. Learned counsel appearing on behalf of the respondent does not refute the submissions made by the learned counsel appearing on behalf of the petitioner. She further submitted that as per the settlement, the respondents/workmen have already received the entire amount. I have perused the settlement agreement dated 6th December, 2023. The application stands disposed of W.P.(C) 9023/2019 In view of the order of even date in CM APPL No.7305/2024, the present petition stands disposed of in terms of the settlement agreement dated 6th December, 2023.

CM APPL No. 7306/2024 The present application under Section 151 of the CPC has been filed on behalf of the applicant seeking withdrawal of the amount deposited in terms of order dated 21st August, 2019.

For the reasons stated in the application, the application is allowed and the Registry is directed to permit the petitioner to withdraw the amount of Rs.2,48,479/- on submitting the proof of identity by the applicant. The application stands disposed of.
