The present application under Section 439 of the Code of Criminal Procedure, 1973 seeks regular bail in FIR No.102/2023, under Sections 395/397/411/506/120B/34 of the IPC read with Sections 25/27/54/59 Arms Act, 1959, registered at P.S. New Friends Colony. 2.
Learned counsel appearing on behalf of the applicant draws attention of this Court to order dated 11.12.2023 passed by Learned Predecessor Bench, wherein it has been recorded that the learned counsel appearing on behalf of the applicant is not pressing the prayer for regular bail and seeks interim bail on the medical ground that his mother has to undergo surgery. 3.
Additional documents with respect to the surgery of the applicant's mother have been placed on record.

Status report has been handed up in Court today and the same is taken on record.

Kr. Jain states that the documents with regard to the surgery of the applicant's mother have been verified.

In totality of the facts and circumstances of the case, the present application is allowed. The applicant is directed to be released on interim bail for a period of one week from the date of his release, on his furnishing a personal bond of Rs. 25,000/- with two sureties of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions:
i.
The applicant shall not leave the State of NCT of Delhi without prior permission of the learned Trial Court.
ii.
The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address.
iii.
The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing.
iv.
The applicant is directed to give his mobile number to the Investigating Officer and keep it operational at all times. v.
The applicant shall not, directly or indirectly, tamper with evidence or try to influence the witness in any manner.

The application is disposed of accordingly.

Pending applications, if any, also stand disposed of. 9.
Date already fixed, i.e., 08.05.2024, stands cancelled. 10.
Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.

Order be uploaded on the website of this court forthwith. 12.
