This hearing has been done through hybrid mode. 2.

The present matter has been adjourned repeatedly at the request of ld. Counsel for the Plaintiff. Even on the last date, an adjournment was sought. 3.

The present is a suit for partition, injunction and declaration between siblings in respect of the suit properties as mentioned in the plaint. 4.

None is appearing for either of the parties. Status quo order was passed on 16th December, 2020 and since then, none has also appeared on behalf of the Defendants. The right of the Defendants to file the written statement was closed on 13th September, 2022, after which the Plaintiff has been continuously seeking adjournment. Clearly, the parties are not interested in pursuing the present suit.

Accordingly, the suit is dismissed for non-prosecution. PRATHIBA M. SINGH, J.
