By virtue of the present application, the petitioner seeks restoration of the present revision petition.

Learned counsel for the petitioner submits that the petitioner is suffering from cancer and other allied diseases and for which, he is undergoing regular medical treatment. He submits that due to the same, the petitioner on 02.04.2026 could neither appear nor instruct his counsel about the date before this Court.

Considering the medical condition of the petitioner as also the document attached with the present application, learned APP for the State submits he has no objection if the present application is allowed. 4.

the notice to the respondent no.2 is dispensed with. 5.

As such, in view of the assertions made as also the no objection given by the learned APP, the present application is allowed, albeit, subject to deposit of costs of Rs.20,000/- to be paid with the Delhi High Court Staff Welfare Fund [A/C 15530110074442; IFSC UCBA0001553] within a period of two weeks.

As such, the present application is disposed of. CRL.REV.P. 859/2019 7.

Upon the petitioner taking requisite steps within a period of one week after depositing the aforesaid cost, issue notice to the respondent no.2 by all permissible modes, returnable on 10.09.2026. 8.

As such, renotify on 10.09.2026.
