The petitioner has filed the present application, inter alia, praying that he be released on bail in the event of his arrest in FIR No. 242/2016 under Sections 420/406/34 of the Indian Penal Code, 1860 registered at P.S. Model Town.

It is pointed out by the learned counsel appearing for the respondent that the petitioner had filed a bail application (Bail Application No. 3300/2018) before the Learned Special Judge, NDPS North. He was admitted to interim bail vide order dated 22.12.2018. However, it appears that the petitioner did not pursue the said petition and the same was dismissed in default on 15.07.2019. The learned counsel appearing for the respondent further states that the petitioner did not surrender after the expiry of interim bail and in the given facts, the present petition is not maintainable.

Since it is not disputed that the petitioner was granted interim bail but had not pursued the bail application (Bail Application No. 3300/2018) and the same was dismissed in default, this Court finds no reason to entertain the present petition.

The petition is, accordingly, dismissed.
